If this is the north section on New York (the section of road all dirt with large ruts and potholes), it is owned and maintained by Clinton Township, not SCS.

That's been the argument for years. Whoever owns it should fix it. Kids trying to exit/enter Born Center are at risk.

New York Street is under SCS jurisdiction until just north of Elmira (right before the section in very poor condition). Then there is a small stretch that is privately owned, which the City should have property records on. The remainder of New York Street is in Clinton Township starting at Lakewood Street, which is actually owned and maintained by the Macomb County Dept of Roads, not Clinton Township.

yes, that is a private road. It is not the City's or County's jurisdiction, although maybe the City could write him up for not taking care of his property????

If it is in the City, you can look up tax records for owner online -- it's public information. Check the city/twp border. I thought it was in the City of SCS. Candice Rusie was replying on this earlier and she is on the City Council - try contacting her to get the City to talk to the homeowner to take responsibility for his property. It has nothing to do with the county.

A private road? Those are not under the jurisdiction of Macomb County. It is not anyone's concern whether or not the road is rutted except for the owner.

You don't like that? Then feel free to help pay for the repairs or just don't drive down it.

By the way, for ruts to really be "2 to 3 feet deep", a monster truck must have made them. Pickup trucks can only make about 6" deep ruts without running out of ground clearance.

Many service vehicles with larger tires travel the road as well, and they have much more clearance than a pick up truck. As far as paying for repairs, or just not driving on it, I'd say it would be in the owners best interest (to his wallet) to fix it. He needs to take responsibility for it - which includes the potential for lawsuits.

There are garbage trucks that go down this street I'm wait for one of them to tip over, that's how bad this road is. This is not a private road. You have to use this street on order to get to the next street over.

You can use Google Maps or Google Earth and do a street level view at Talbot and New York in Clinton township to see for yourself. As soon as we get rid of all this snow I will start taking picture and videos of just how bad this road it. This has been going on for over 3-years.

If I was the owner, I would just block off this road to ANY traffic. No one seems to appreciate being able to take this short cut. It is a private drive!

There is no indication anywhere that is it a private drive. It looks like an unpaved road to the casual observer. I guess the fact that no one is fixing it might confirm that it is private though! It is unreal for sure.

All cities have standards for safety and appearance of private property and this is one case where they need to use their authority and enforce city and/or county codes and force the owner to maintain the property.
