Tiki torches - fire? No portable bathrooms?

This continues to be an escalating problem. If they would go in and clear out these camps perhaps that would stop this kind of behavior. Unfortunately, it is getting to the point where folks who live in this area cannot enjoy the trails. Thank you for staying on top of this issue. I only wish our city government would respond.

A September 4, 2018 federal court decision (9th Circuit Court of Appeals) ruled that local governments may not enforce local ordinances prohibiting camping on public property, as well as related activities that are “universal and unavoidable consequences of being human” such as sitting, lying or sleeping, if the local jurisdiction does not have sufficient number of indoor shelters to accommodate all of the homeless persons in that jurisdiction. In that situation, local governments are prohibited from citing or arresting anyone sleeping on public property.

Re: the official comment above, while the the court ruling allows sleeping in public spaces, it still allows cities to enforce against setting up encampments and storing camping equipment on public property. The protocol used in Folsom is for code enforcement to tag the site for removal, giving squatters 72 hours to get their stuff out of there. We need to keep pressing them to do this each time an encampment forms.

Response to "verified official" comment. Tiki torches, feces, trash, etc are public health and safety issues. Unless I'm mistaken, the 9th Circut decision does not state public safety and health are to be compromised and put at risk for "...consequences of being human."

Our quality of life is eroding here; our health and safety are being put as risk. Thank you for reporting and challenging the city. These people are driving us out.

65 year old resident reported being threatened while walking on trail in this area on Wed. Rapid response from FPD. Individuals camping were abated from the area and an arrest was made on Thurs. The actual homeless team handled the abatement with code enforcement.
