The new construction and removal of approximately 200+ trees, and constant parade of dump trucks and earth moving equipment has caused Seneca Drive and Martin Road to be covered with dirt and mud. The mud needs to be removed. The construction company street sweeper truck only further distributed the dirt and mud and worsened the situation.

We acknowledge that the contractor had deliveries yesterday from flat bed trucks which tracked onto the road. Unfortunately we can not be at the site during all work hours. We were alerted of the problem yesterday afternoon so the first we were able to respond was this morning. Ideally we can be called directly and can respond much quicker, which is our preference.
We do not issue fines. As a rule our enforcement goes from a repair order when items are identified that need repair, a notice of violation if items are not repaired in a timely manner, and stop work orders. We will issue a stop work order but the contractor had already stopped work on the site today and items were being repaired. Had we been at the site at the time of the violation yesterday and identified soil leaving the site we would have stopped the work. For your question, when we evaluate we differentiate between staining of the pavement and actual soil being tracked into the street. Photos can be difficult to interpret so getting the information quickly and getting to the site is key.
Right now I feel that we have had a good discussion with the contractor to move forward. We will continue to monitor closely as we are able.
