Not sure how transfer of ownership has delayed this case. Considering under section 107.6 of the IPMC as adopted by the city, the sale is not allowed to go through unless the new owner fully acknowledges and accepts the responsibility for fixing the problem. If the prior owner did not produce the notarized statement to this extent (required to deliver notarized statement to the code official), I would assume the city has the authority to cancel/reverse the sale and stop dragging out these issues and continue prosecuting the previous owner under the original case. I would also assume the notarized statement from the new owner should have a clause or statement with a monetary statement showing proof that they are able to bring the structure up to code and properly comply with the code issues. Otherwise there is no recourse for failing to having the new owner sign the statement other than for the city to verify that the structure is/will be brought into compliance. Just general feedback for watching these cases drag out for years upon change of ownership and bench warrants.
