Sec. 94-254. - Obstruction
No person shall block, barricade or obstruct an alley within the city except as otherwise provided in this Code. (Ord. No. 831, § 4.403, 2-5-1996)

Sec. 94-111. - Building materials
boards, bricks or other materials in or upon any street, alley, sidewalk or other public space. Such material shall not be allowed to remain in such street, alley, sidewalk

Thank you but, this is not a City matter.

Sorry to disagree but unless the City is saying it doesn't own the alley then it is a City matter. If the City has decided it has no ownership of the alley, this needs to be communicated to the adjoining building owners in an official manner.

How could this not be a City matter?
The City claims to own the alleyway.
The City warns or tickets vehicles intermittently parked in the alleyway for obstructing it.
The City is neglecting to enforce its own ordinances by allowing unpermitted construction in the alleyway setback/easement which is preventing neighbors which utilize that alleyway from accessing it by trucks, fire/emergency svcs, and dumpster services.

Because the City is neglecting to enforce its own ordinances as it pertains to the construction of the unpermitted sign/gate/post/pot (which exists solely to disrupt traffic at the cut-around), not only are adjacent property owners paying more money and taking longer to trash-out and restore adjacent buildings-- other neighbors are complaining about the LACK of a dumpster and how long removing debris and materials manually via light truck is taking; so enforcement here would mean fewer complaint postings and fewer issues between the owners and tenants themselves.

Please enforce the City's ordinances here- neglecting to enforce this has and will continue creating additional costs for nearby owners (monetary damages).

Maybe the attached will help the city staff understand why neighboring property owners are upset. The yellow line roughly marks the edge of the right of way which the city refers to as an alley

Sign is back sticking into the alley today.

It shall be unlawful for any person to willfully enter upon the lands or premises of another, within the city, without lawful authority, after having been forbidden to do so by the owner or occupant, agent or servant of the owner or occupant, or any person to be upon the lands or premises of another upon being notified to depart therefrom by the owner or occupant, or the agent or servant of either, who, without lawful authority, neglects or refuses to depart therefrom. (c) Verbal requests not to enter or to leave the premises, or posting of conspicuous signs indicating "no trespassing" or "premises for use of tenants and invited guests only, all others prohibited and subject to criminal trespass charges" shall be sufficient notice forbidding use for the purposes of this section. (d) A person who violates this section shall be guilty of a misdemeanor and upon conviction thereof shall be punished by imprisonment in the county jail for not more than 30 days or by a fine of not more than $50.00, or both, in the discretion of the court.

What is your point? Why would you assume I did "enter upon the lands or premises of another".

Are you trying to say it is unlawful for me to stand in the right of way and remove an obstruction by placing it back on the owners property?

If you did your job and stopped the property owner from placing their junk in the right of way in the first place, I wouldn't have to move it so cars aren't damaged by their junk

Why didn't the ordinance officer deal with the sign in the initial picture.
The city's sign fact sheet clearly states the sign is prohibited.

Did the City issue a permit for this sign? That would be surprising since it doesn't meet the qualifications for approval. If not, the sign is still not allowed per the city's rules

Unfortunately, I am unable to respond to this complaint -- since this is not in my purview -- I would recommend that you speak directly to James Jackson, Ordinance enforcement Officer - at 482-2061 - rather than continuing to go back and forth on clickfix. thank you!

Nan - I understand you are unable to respond.

Mr. Jackson has a history of preferential treatment towards the offending party and therefore in my opinion Mr. Jackson is not objective in this matter.

I am quite willing to hear Mr. Jackson's explanation of why he is not enforcing the sign ordinance, but to close an issue without resolution or explaining why the sign is in compliance is unacceptable to me as the one who posted the issue.
