Rails are covered by federal laws. They cant be covered.

These rails are not used anymore and they were paved very nicely some years ago, but it has since deteriorated.

People should research things before they write about them. The tracks belong to Ulster County, who leases them to the Catskill Mountain Railroad. The CMRR is an all-volunteer group, who is working to restore the line and eventually offer passenger and freight service to the Catskills again. The railroad is active and is covered under federal laws. The tracks do not actually cross 209. 209 crosses the tracks! Notice that the rail cars stored there are in the process of being prepped for movement for scrapping and restoration as appropriate. Some of the equipment has already been placed in Phoenicia where it has been lovingly restored. The railroad is currently in compliance with its lease and should be commended for the hard work and hard-earned money they have invested in this economic (and tourism-boosting) resource. They are saving history before it is lost. I can't wait to ride the train from Kingston up to the mountains! I see them out working all the time. Keep up the good work!

Oh well, it will serve to knock the snow out of my wheel wells.

The DOT can work with the RR to pave the road smoothly, while still allowing the railroad equipment to pass. Trains can derail if road crossings are built wrong. When I stopped to look at the crossing, it didn't look like any properly-built crossing I've ever seen. I guess we all got used to the inactivity of the tracks. My truck shakes like a dog crapping a peachpit when I drive over it, so I agree with your call to action.

I reported it to 1-800-POTHOLE, and they fixed it!!! I noticed it diving over the tracks yesterday. They did not cover the tracks, they just repaved around them. Thank you, State Highway Dept!
