any portion of any tree leaning over your property you have the right to cut

I’ve already had all branches trimmed that hang over my property. Unfortunately when a tree or branch falls, it does go straight down. The tree is 50-60 ft vertical and yards are only 16 ft wide. Half of it is dead (no leaves, sap oozing our) and leaning toward my yard and home. I’ve already informed my insurance company to put them on notice in case of an incident but I’m more concerned of safety because size of tree would easily kill or seriously hurt someone.

Yes, housing code can enforce the owner to address the issue. I will forward to housing code.

Spoke to constituent, Farut via phone. Constituent will be away next week. Scheduling an inspection for the following week on 7/12/19.

7/12 there was no entry. Rescheduled with constituent for 7/15/19, another no entry. Constituent will call back to reschedule.

Constituent contacted office. Rescheduling for Friday 7/19/19.

The owner of 318 York St, has trimmed his tree in the rear. This violation has been abated by officer Rodriguez.

Please explain how a tree that has no leaves in the middle of the summer, bark peeling off, sap oozing out, rotting branches and green moss all over deemed SAFE? Please see picture from my roof to provide context of size and condition of the tree. The home owner is being negligent and the city has the ordinances in place prohibiting property owners from keeping dangerous conditions on their property. Both our lots are 16 ft wide so trimming the branch on the property line does nothing. If the tree and/or branch falls, it will certainly damage my property or worse my family. I have informed my insurance company and now put the City of Jersey City on notice that if this tree causes any harm to my family and/or property, I will pursue legal action to not only against the property owner but the city as well. Please send someone from Parks and Forestry to properly assess the health of the tree before deeming it safe. Please re-open the complaint.

The Tree is on Private Property, Parks and Forestry does not remove trees or trim them that are on Private Property. Also, from Housing Code Enforcement, The issue has been abated.
