My name is Eldon James Brown and I am a tenant of the All Star Hotel, 2791 16th Street, San Francisco, California, which is managed by the Tenderloin Housing Clinic.
On November 12, 2012, I addressed the Commission (SF Human Services Agency Commission) during the public comments session of a regular meeting, concerning numerous San Francisco Department of Building inspection Notices Of Violations which were unresolved. One of those NOV’s (# 201234101) had been unresolved for so long that an Order Of Abatement was issued (order # 104779-A) after a San Francisco Department of Building Inspection Code Enforcement Director’s Hearing. The Order Of Abatement remains unresolved as of the date of this letter yet, your Commission continues to award grant modifications as though the property is without serious violation.
An unresolved Order Of Abatement renders a property a “public nuisance” and in this particular case, directly relates to the structural integrity of the building itself. In general, the NOV for which the Order was issued requires a “design professional”, more commonly known as an Architect or Civil Engineer, to evaluate the building and submit a report. The NOV (# 201234101) was issued on June 4th, 2012, the Order Of Abatement was issued on October 23rd, 2012 (4 months and 19 days later) and remains in effect as of today (1 year, 6months and 9 days total). There are three additional Notices Of Violation that remain, all of them predating the aforementioned. They are as follows;

As I understand the contract to read between SFHSA and the Tenderloin Housing Clinic, a breach of that contract has occured when a property is non-compliant with city and state building codes.
After complaining about the substandard conditions of the building to the Commission on November 15, 2012, during the public comments section of a regular meeting, the Commission members refused to second (approve) Tenderloin Housing Clinic’s grant modification. Ms. Yolanda Calloway (accompanied by others) immediately performed a “physical site visit” after the November meeting adjourned, in my absence. The very next commission meeting on December 20th, 2012 the Tenderloin Housing Clinic was approved for a grant modification with an additional sum in the amount of $100,000, presumably to effect repairs. This was done without any mention of the building code violations plaguing the All Star Hotel (to my knowledge), nor were they detailed in any of the supporting documentation. I did not attend the December 20th meeting as it was not posted online prior to the meeting being held, nor was a December 2012 meeting agenda physically posted outside of the Ronald H. Born Auditorium as is usually done. This was a violation of the San Francisco Sunshine Ordinance.
Nearly one year later the property is still under an Order Of Abatement with open NOV’s.
The original grant modification in the amount of $153,415 should not have been awarded while in serious breach of contract, nor the eventual amount of $ 260,000.
In my opinion, these actions in total constitute the elements of conspiracy, grant fraud and criminal fraud by both the Tenderloin Housing Clinic as well as the San Fransisco Human Services Commission. I, as both a tenant of the All Star Hotel and as a resident of the City and County of San Francisco, would like to know what you intend to do to either compel the ordered repairs or in the alternative, recover fraudulently obtained public funds.
