Description

I am seeking information about a developer's responsibilities for maintaining dust abatement barriers and controlling weeds in residential neighbors that are still under construction after many years. I would like to know whether it is appropriate for the developer to use HOA funds, which the developer controls, to pay for its dust and weed management responsibilities. Based on information recently shared by the HOA management company, I suspect that this situation might be now occurring in my neighborhood. I further anticipate that the developer-controlled HOA will soon announce a increase in HOA member fees to cover a recent dust barrier replacement and weed removal on the developer's vacant lots. To the point: Am I mistaken in thinking that there is something wrong with homeowner HOA members being held partly responsible for the developer's business obligations to control dust and weeds?
