Still nothing done here after MONTHS - but a slip risk sign is a nice add. When can citizens who use this greenway expect a fix for this overdevelopment caused issue?
§ 113A-57. Mandatory standards for land-disturbing activity.
No land-disturbing activity subject to this Article shall be undertaken except in accordance with the following mandatory requirements:
(1) No land-disturbing activity during periods of construction or improvement to land shall be permitted in proximity to a lake or natural watercourse unless a buffer zone is provided along the margin of the watercourse of sufficient width to confine visible siltation within the twenty-five percent (25%) of the buffer zone nearest the land-disturbing activity. Waters that have been classified as trout waters by the Environmental Management Commission shall have an undisturbed buffer zone 25 feet wide or of sufficient width to confine visible siltation within the twenty-five percent (25%) of the buffer zone nearest the land-disturbing activity, whichever is greater. Provided, however, that the Sedimentation Control Commission may approve plans which include land-disturbing activity along trout waters when the duration of said disturbance would be temporary and the extent of said disturbance would be minimal. This subdivision shall not apply to a land-disturbing activity in connection with the construction of facilities to be located on, over, or under a lake or natural watercourse.
(2) The angle for graded slopes and fills shall be no greater than the angle that can be retained by vegetative cover or other adequate erosion-control devices or structures. In any event, slopes left exposed will, within 21 calendar days of completion of any phase of grading, be planted or otherwise provided with temporary or permanent ground cover, devices, or structures sufficient to restrain erosion.
(3) Whenever land-disturbing activity that will disturb more than one acre is undertaken on a tract, the person conducting the land-disturbing activity shall install erosion and sedimentation control devices and practices that are sufficient to retain the sediment generated by the land-disturbing activity within the boundaries of the tract during construction upon and development of the tract, and shall plant or otherwise provide a permanent ground cover sufficient to restrain erosion after completion of construction or development within a time period to be specified by rule of the Commission.
As someone who has reported this issue as well, over a month ago, I am SO SO tired of having to step in 2-3 inches of water on my runs and walks at least twice on this greenway during each outing. This wasn't happening before the development across from Lowes. ANOTHER post about this same issue had a WF Engineer calling this a lowland/floodplain area - did the topography miraculously change coincidentally AFTER construction began high up on the hill? Because this wasn't happening before the construction. I've been running this trail for years. In addition, the other "low" spots on the trail have all dried up with the days of hot weather and full sun and yet this spot stays wet and the same depth day after day in the same conditions. This isn't a simple annoyance - it's so deep that you can't run or walk through the 20+ feet of water without soaking the inside of your shoes - it's IMPASSABLE. Come ON! At some point if you're not going to hold the construction company accountable to fix this permanently then the town needs to do something for it's tax-paying residents and lord knows with the amount of new residents incoming, we should have PLENTY of money.
I'm sorry, but the town's response is not acceptable. What is being done - actually done - to address this issue? Not only is the developer in violation of DEQ regulations, but the town is culpable in its refusal to enforce a corrective action. Please provide what is being done, citizens deserve to know.
We would like an update from a Town of Wake Forest representative on if the issue has been corrected and who is monitoring it. Do not close the issue if it has not been corrected for the long term. Thank you
Thank you for reporting this issue. We are aware of this and have been actively working with the developer to find a solution. We have increased our inspections of site to ensure all Erosion and Sediment Control measures are working properly. I will leave this report open until the issue is resolved.
On Friday, July 29th Town staff performed maintenance work along this area of the greenway to alleviate flooding. We will continue to monitor this area routinely. Thank you for your patience on this matter.
