This was permitted prior to the new Tree Ordinance. The trees are protected by both orange fencing and silt fence, there is an existing driveway along the trees root zone and this is a renovation not a demolition and new build. The site is being monitored to make sure root zones are not impacted any more than they already were. I will forward the complaint of dangerous open construction site to the building division.
You're telling me that there has never been a tree protection requirement before this? All I see are trees being killed, before the tree ordinance, after the new tree ordinance. These are going to be the next two trees killed while Brookhaven sits on their hands. The builder is grading right up to these trees and there is nothing left of the old house and you call this a renovation??? I thought if over half of a building is redone it needed a real building permit.
There is and was a tree protection ordinance as far back as 1999, they both allow for removal of trees from the buildable area of the lot within the building setbacks, and impactions to the root zone of the trees of up to 20% per Arboriculture standards. There was an existing driveway in the root zone of these trees that was done when the original home was built. other wise the trees have not been disturbed to date. We will monitor the site for compliance to the approved plans and code.

This company has a very poor track record in our neighborhood - and also has many properties. Other companies follow the rules and we want to make sure that they do as well.
The Chief Building Official met with the Builder, who will organize the site and construction will resume after Thanksgiving. The Building inspectors will continue to monitor the site for building code compliance.
I guess trees were only allowed to be removed when they built "concerned's" house. Everyone on this site needs needs to chill it over the trees. Ordinances are in place and for the most part followed. Just because your house is 30-40 year old and trees have grown back doesn't mean none were removed to build it. Remember that others get the same privileges as you when building a house.
No Tiffany, the current tree laws require that builders protect the trees they say they are going to leave. This builder didn't protect those trees, I guess I thought the building permit was issued recently because there isn't much done on this house. So don't accuse people of making such a big deal, because it's the law now. OMG girl!
Tiffany - we don't need to chill out about trees - we need to stop bad builder practices. Sure, that might shave some of the profits from your next redi-made house, but some of us actually care about our community. Not everybody is selfish!
There is no violation here people! Get over yourselves. What is wrong here? Nothing, you just dont like the rules so you make up your own. They did this exact same thing when they built your home, let others have a house in brookhaven as well. You aren't trying to save trees, you are anti new development
