Pinellas County “Doing Things for YOU” !
Thank you for letting us know the issue that you reported has not been resolved. Your report has been resent to Pinellas County Neighborhood Code Enforcement to be investigated.
Seems to be a problem with unincorporated code enforcement. Must have a one man/woman team or something. Things are getting really bad in the Orange lake section off Seminole Blvd and 110th Ave N.
It is very difficult to see, by your photo if the RV is over the sidewalk? If this is the case please contact the Sheriff's non-emergency number 727-582-6200 as this would be a state statute violation, enforced by the Sheriff's Dept. If this is not the case there is no violation as long as the tag is current. Thank you and have a nice day.
You are incorrect, it is illegal per County Code No. 122.37 - as follows:
Sec. 122-37. - Storage, parking, maintenance of prohibited vehicles and equipment in residential zoning districts.
• (a)
Intent. It is the intent of this section to prohibit the storage, parking or maintenance of prohibited vehicles in residential zoning districts in order to prevent traffic and safety problems endangering the lives and property of citizens of the county, to prevent unsightly appearances in residential areas, and to prevent diminution of property values.
(b)
Definitions. The following definitions shall apply to the provisions of this section:
Commercial purpose means a use for compensation, including but not limited to the transport of persons, animals, commodities, materials, articles of trade, or the performance or tender of services.
Prohibited vehicles and equipment means and includes, but shall not be limited to, any truck, trailer or stretched and/or extended automobile or sport utility vehicle in excess of 21 feet, or any semi-trailer, tractor trailer combination, or truck tractor as defined in F.S. § 320.01(11), or any step-van, cube-van, box truck, flat bed truck, tow truck, wrecker, moving van, bus, or any construction, landscaping, or land clearing equipment. The term also includes any vehicle used as a platform for a derrick, hoist, crane, compressor, tanks, ladder racks, or similar equipment or as a means of transporting or storing a prohibited vehicle. "Construction, landscaping or land clearing equipment" as used in this section shall include, but not be limited to, any front loader, bulldozer, dragline, crane, or similar vehicle, or any tar pot, concrete mixer, trencher, stump grinder, brush shredder, or similar equipment designed to be towed behind a motorized vehicle.
Residential zoning district means the boundaries of an area of the unincorporated part of the county designated by a single zone residential classification with uniform use regulations, and includes private and public property. When streets or alleyways are used to designate boundaries, such boundaries shall be considered to be the centerline of such streets or alleyways.
(c)
Prohibitions. No person or agent thereof shall cause or permit a prohibited vehicle to be stored, maintained or parked in a residential zoning district unless such vehicle is parked on private property in an enclosed garage or similar lawful structure, thereby eliminating its visibility from public roads and adjacent parcels of land. However, one such vehicle may be parked on a residential property for no more than 30 minutes during the normal lunch hours of 11:00 a.m. to 2:00 p.m., not to exceed one 30-minute period per 24-hour day.
(d)
Exemptions. The provisions of this section shall not apply to the temporary parking of prohibited vehicles in residential zoning districts for the purpose of delivery or receipt of goods or services at a specific residence. Additionally, for each residential dwelling unit there may be one van, pick up truck, or utility trailer, with attachments such as ladder racks, utility beds, flat beds, glass racks, side racks, or elevated tool boxes. However, the vehicle together with any and all such attachments and/or cargo and equipment shall be no more than 21 feet in length, eight feet in height, and eight feet in width. The vehicle must be parked on a prepared, inorganic, hard surfaced, non-dirt, parking area and not on the grassy or vegetated area of the yard. This section is not intended to include operable boat trailers with or without boats, or other recreational vehicles as those are addressed in chapter 138 of this Code.
(Ord. No. 83-22, §§ 1—4, 12-6-83; Ord. No. 04-54, § 1, 7-27-04)
I will call the Sheriff, again, and tell them how to do their job......
Dear Mr. Frederick, Chapter 122 of the codes that you posted does not apply to this RV. Please refer to the very last sentence under D of the exemptions that excludes RV's from this code. This is the reason no action will be taken regarding this concern. Thank you and have a nice day.
Thank you. I was made aware of this error in your codes, which is why I was trying to contact Commissoner Long about why the 2005 amendment was not approved. You can't have a one size fits all ordinance for a diverse county. If I have to live across from a trailer park my taxes should reflect that - one might think.
Michael, problem is no one else gets upset until it happens to them. I'm just as frustrated with the lack of an ordinance. I wouldn't mind if the got their toys behind the homes frontage and most decent folks do. The ones that don't...don't care.
The problem is the last time they had a meeting on this ordinance all the boat and RVs rallied in opposition. The People that aren't affected don't care until someone does this in front of our house. So they gave in to the majority at the meeting which is not a majority of the county. If they had considered the true population and the fact that most only care when affected they'd have done their job. But in the end they are spineless politicians that only care about being re-elected.
It's not a one size fits all situation. I'm sure there are many more rural locations where no one cares if you park an RV or boat on your front lawn, but in a single family residential neighborhood makes no sence. I plan to invite Commissioner Long out to have a look. I know a couple of my neighbors will join me. Your welcome as well.
This is not an ordinance. The Board of County Commisioners didn't vote it into law because the RV and boat owners (who don't care what their neighborhood looks like) rallied the board against it, the board failed to stand up to the minority( folks who parked on lawn). Most folks put their toys away, either behind the fence, on the side of their yard, in the back yard or in a storage yard. Residents who don't own RV and boats don't care until the boat or RV is own the lawn next door or across the street. The BCC needs to recognize that. A one size fits all law won't work in residential communities or developments. I suggest the ordinance mirror Dunedin's. Which limits vehicles to the driveway and by type, length ,width, height and weight. and never on the frontage or exposed on the side. There are folks who have large rural properties were this shouldn't apply and people should be able to to have them in their driveway for trip preparation, cleaning and unpacking. But storage on the front lawn...never.
