(a) Using the public streets of the city for purposes of storing vehicles or parking vehicles for a period of time exceeding 24 consecutive hours shall be deemed a violation of this division. (b) Any person who desires or needs to park a motor vehicle upon any public street in the city for a period of time exceeding 24 consecutive hours may do so and not be deemed in violation of this division provided that the person notifies the police department. Prior to granting a waiver of the 24 consecutive hour time restriction, the police department shall be required to determine that: (1) The safety of the persons traveling on the street upon which it is desired to park such motor vehicle will not be endangered. (2) The reasons stated for parking a motor vehicle more than 24 consecutive hours are such that the granting of a waiver is necessary and reasonable. (3) There is no other location in which the motor vehicle could be parked for such a period and which request to relocate the vehicle is reasonable to the owner. (c) Upon determining that a waiver is justified, the police department shall record for its records the name, address and telephone phone number of the person seeking a waiver along with a detailed description of the vehicle involved. The police department shall be charged with the responsibility of determining that the waiver is enforced and upon expiration, that the vehicle is removed from the location. (d) Exceptions to the 24-hour parking restriction are any properly licensed and plated motor vehicles that are mechanically sound and operable and are owned or registered to a residential property owner and parked on the street area directly in front of said property.
