Zoning permit 78-115 has a site plan on file that designates the back yard as a 81 x 43 foot parking area. This would not be allowed under today's ordinance but it was filed in the permit from 1978.
City officials from my office have reviewed this and previously issued determinations of no violation because it is a permitted parking area.
We have found that the property owner has allowed tenants to park there each winter and he restores the back yard in the Spring. By using the parking at least every 12 months the property owner appears to be within his rights to continue in this manner under the permit. We will follow up regarding the conditions of the yard as the weather warms.
We cannot issue parking tickets for yard parking in this case.
