Looks like a "sleeper" or "deadman" wall used to secure the long foundation wall. If buried, it is often legal.

I am also concerned about the height of the first floor of this new home. The threshold appears to be about 7 - 12 feet above the previous home's threshold. It was my understanding that builders had to take the average height of the previous home into consideration when building a new one.

Hmmm, is it the height or the setback that has to be taken into consideration? I think I had read that a house cannot be any closer to the street then it's neighbor's, but not sure there is a height restriction relative to the house next door.

There are zoning restrictions about setbacks and height in the R-75 classification. When they build a new house, they have to use the average of the previous home's threshold elevation - the one they tore down, not the house next door - into account. The previous home was set much lower on the site, and it also appears the builder built up even the ground level with a mountain of dirt, so the threshold of the first floor is much higher than the previous home on the lot. It's also interesting that in the time between someone's complaint about the encroachment on the 7 1/2 foot side setback, the entire house has been built. What will Brookhaven do about this? Fine the builder and allow this to stand?

The builder has done nothing wrong. Brookhaven abolished the threshold requirement a long time ago

Sad but true: Brookhaven trashed the threshold requirement just like they have to all other constraints on development. This is why the builders have FLOCKED to our neighborhoods - they know that they can get away with it while the substitute teacher is in charge.

If you really want Brookhaven's attention use their preferred bait: adult devices. Rumor has it they can hear a vibrator turning on at 100 yards.
