Disparate Impact can only be understood with a comparative condition. The Montessori School on Edgewood is in a neighborhood that is 23% White. The sidewalks in front of Thomas Hooker School on Whitney Ave, are perfectly ADA-compliant. It is in a neighborhood that is 62% White.
It is unintentional, of bourse, but intent is not required tor discrimination to exist and the data and evidence says what it says. Brown v Board of Ed. requires that transportation to and from public schools be equal. Sidewalks are a from of transportation. Safe transpiration is not provided equally and that inequality is coincident with the ethnicity of the students.
