Muddy water draining from the construction site on Heritage Lake Rd started flowing heavily across the Dunn Creek greenway while we were walking today. The Ledge Rock development site near Cardinal Hills was pumping water through a drainage pipe into the creek. Are construction sites allowed to divert their waste water onto the greenway and into the creeks?

How can we get the offender to immediately stop dumping into the creeks?
Who do we call to get to come out quickly to "catch" them doing it?
Will it do any good to take pictures of them actively dumping?

It is my understanding that the first offense receives a "warning" and the second offense receives a "fine".
I believe a warning should be given at time of permit issuance.

Thank you for reaching out with your concerns regarding the drainage along Greenways. Greenways are often constructed within the flood plain and along creeks and streams. Due to this, they are often flooded during large rain events and see drainage and ponding following events due to the amount of time for ground water to naturally drain. Both the construction sites referenced are along this natural flood plane corridor as well as the greenway.
Town staff will investigate the issues further. During the last investigation, it was determined the water that was draining toward the greenway was draining from a special sediment basin which is an approved erosion control device. Water cannot be diverted directly into a creek or natural area, offsite, without being treated. In both of these instances, the water flowing may appear to be "muddy" but has been treated properly and typically just has a resulting brown hue.
We will follow up with what has been determined upon further investigation of both sites.
