I would like to file a noise complaint against Cemex and surrounding plants at 333 23rd Ave, Oakland, CA 94606. They have a rail servicing the area and the train blasts its horn without any regard to the surrounding residents, typically at 1-3am in the morning. It is almost as if they are trying deliberately to wake people up. There are rail road crossing signs and gates there, the train does not need to blast the horn so loud for so long. On the morning of 1/29 around 3:30am, the train blasted its horn several times, each time for more than 10 seconds. Why are they able to do this to the residents nearby?

Yes, the train services Miller Milling and the horn blasts are in accordance to Federal law. The engineer has to blast 'one long, one short, one long, at every intersection. Lancaster, Derby, Peterson and 29th/23rd/Park.
That train has been going down those tracks for 60 + years? Sheeeesh?
Remember in the U.S. the power order is Mother Nature- the railroad- the federal govt- the state govt- local govt then us 'peons'

Miller Milling would LOVE to have the train run during the day. Pre 2009 the Friday run was at noon. The train sat on Glascock for an hour+ trying to get across the 29th Junction. It would block the entire length of Glascock.
Those lights by the 7-11... They were put in 6 months ago. I have seen the idiots racing in front of the train trying to get to or from Park St Bridge, Even with the new lights flashing.
Miller Milling just did some earthquake upgrades and have a new 25 yr lease on their property. They ain't going anywhere.

I'll say... you've heard the expression "railroaded"?
The train guys are supposed to honk all the way down the street, only one of the engineers follows that particular rule which wakens neighbors (not to mention the noise of the train). CJ and I have been trying to change that, but with little luck. Also they are unlikely to change their schedule... think of the problems it would cause to have a multi car train going down Glasscock and across 29th Ave during working hours. If... they got across 29th... they would soon go back to their nighttime runs.

sounds like the law is on the bad guy's side
the only way it seems, is to write to Miller Milling's customers, inform them of this ridiculous situation and ask them to not buy from Miller Milling. If Miller Milling is closed down, the trains should stop.

Dear TheyreCensoring,
Sheeseh was not a troll but an active member of the Jingletown community.
He passed away from complications caused by the flu, a week ago. He has left a large empty hole in our community. His knowledge of City, laws, rules and regulations was unlimited. Yes, sometimes his comments were harsh, I would mention that to him on our daily meetings while walking our dogs . We were a great team, making positive changes in this neighborhood, while being a voice for residents who have lived here for decades.
Don't worry, your feelings won't be hurt anymore.

I didn't know sheeeesh! in person and wasn't aware that he passed away. Sorry for your loss, Cynthia.
Unfortunately he did have a habit of trolling people on this site whenever they reported noise issues, usually saying something along the lines of how we shouldn't have moved here and dismissing/downplaying our well-merited complaints. He did this to me and many others, hence why I called him a troll and advised others to ignore him when he did this.
It's unfortunate that he passed away but I stand by what I said.

Sheeseh was not a troll. Trolls sit at computers and rant, yet never move away from their screens. Sheesh came to every neighborhood clean up, he came to every NCPC meeting for our beat, he met with City officials to make sure our neighborhood was heard. He rented his units at below market rate to people who would get involved in our community. Yes, Sheesh was combative, overly so, and I was always on him to tone it down. But he was not a troll, he was passionate about this neighborhood he lived in for 38 years.
I now invite you to come out to the Jingletown streets and engage in Jingletown events,. Face to face with your neighbors.
