This has already been fought and deemed for public access, any attempt by owners of home and restaurant to block access are illegal. This is also supposed to be an emergency vehicle access.
I'm very concerned about what this all means to the public's right of way. There's no reason this public street should be in such an impassable condition. Construction debris, trucks, piles of materials IN the right of way. SMH
Maybe we could get some parking time limits established? Like a 2 hour limit? I'm not sure what the signage says there - but some of those trucks have been parked there for a long time.
Enough is enough this property owner has no respect for his neighbors or the neighborhood. He feels he owns this City Owned/Taxpayer Owned steet and has a long history of dumping, blocking and restricting access to residents and seems to have immunity from any action from the city. It is about time we take back our rights and property from those in power who have long been influenced by the wink and nod actions of the "Special Friends of the City"
When i tried to access the beach on sunday morning there was a trailer and two trucks blocking the entrance. i had to walk to the right of the trailer and squeeze in a 2 ft wide spot holding my dog. I guess there was not side walk. this is a disaster. are the palm trees allowed planted on the beach?
Alderman Sal is on top of this working with the City to get the site cleaned up. However, the work trailer is there by permit and therefore, legal. I am closing this issue, but someone please reopen should the situation deteriorate in the future. We need to stay on top of this.
It's not just the truck, it's the big pile of dirt that obstructs the right of way. There is not just one trailer, there is also a huge dumpster. Until the right of way is re-established, this issue should remain open!
Nothing has changed from this picture. He may have a permit to have a work trailer on site but not to have a pickup truck parked in what would be the middle of the road. He has removed the sidewalks and has the same construcit on waste material on City Property. Where I come from that is restricting access and dumping who know s .what. Alderman Sal's come see come sah doesn';t work for me A little drive by might help him understand how furious we are.
This should remain open until everything cleaned up. Right of way used for storage of pallets. One was broken with materials strewn about. Restaurant has extended seating and decor onto public beach which has led to guests leaving their garbage on public beach. Boards and other building materials have been dumped on public beach and access area.
Anthony's does not have the right to appropriate public property for his castle-building or for his business needs. Or is NH going to sell him the right of way? They're selling everything else that isn't nailed down. No one is "on this". Alderman is a shill for the Democratz Party or he would be out picketing with the people about this abuse by Anthony's and neglect by the City. When will it end?
The next East Shore Management Team meeting is Tuesday, June 11th at 6 p.m. at the Fire Station (at the corner of Lighthouse Rd). I have another meeting & can't attend, but maybe someone could go & bring up the issue there? Usually, the aldermen go & Livable Cities Initiative reps are there too.
The use of the Public Beach for his business and profit is illegal wihtout a Permit and is at the expense of the Taxpayers'. My neighbor's son was asked to leave the beach area via Anthony's Oceanview bullhorn over the weekend. He is not allowed to use the beach in the operation of his business and he knows no boundaries. I agree that the City and the "New Sherriff" aka the Alderman turn away and a deaf ear. This is not representation of the neighborhood or the ward. He will make a play for the street known as Cove Place and intimidate those using the Beach Access and City Owned Beach. Watchout this is Anthonyville not Morris Cove in his mind!
I was able to access beach today but I am still concerned about the fact that a public sidewalk( I Assume it is public) has a trailer sitting on it. this can't be legal. I was not chased off the beach and I am really concerned that someone was. This is a public beach ...isn't it? If this behavior continues might I suggest a bit of a rally??? a peaceful one of course!
I also live in the neighborhood and I didn't even realize that this was a public beach. I thought that it was owned by Anthony's. There should be a sign up so that everyone in the neighborhood can enjoy it.
At the East Shore Management Team meeting last night, Alderman Sal DeCola reported that the beach access road is under ongoing observation to prevent building contractor violations. Great work everyone!
Driving by I noticed palm trees. Someone who had been in the beach recently please tell me that Anthony's didn't plant palm trees on the beach. Please tell me they were decorative and removed.
Where is the ALDERMAN, he doesn't go MT meetings, doesn't return calls. Walks around like above it all! This needs to be fixed once and for all, Cove Place is a public street not Anthony's street. Alderman DeCola please do the job you were elected to do! Stop this now!
i would call justin elicker, brian wingate, or doug hausladen. they are the only people who know how to get anything done in new haven these days. the other politicians here could care less about our neighborhoods.
I read everything , and youre all wrong . All five of you . And everything you have done about this has been wrong . I have accomplished more results in your favor than you so called good residants. This Thread isa shame . Your lack of goodness isa shame. I
Our hardly ever seen alderman showed up at the East Shore Management Team meeting last week. Hey, there's an Election next month! Anyhow, he says that he spoke to Anthony's and they will clean up the area. The truth is, it is almost November so Anthony's is no longer using the entire beach for weddings and no longer cares about the locals using the beach. They probably will clean it up. Come next April/May, watch the road mysteriously become impassable again as the beach weddings resume. Then we will find out if our alder cares enough about his constituents to fight for our beach rights or pulls another disappearing act.
There is a very small area in front of the so called "right of way", (the street stub called Cove Place) that is 30 feet wide and travels to the left at about 10 degrees, all the way to the water. Once below the high water mark, you are free to go anywhere, all the way down to the seawall if you want at low tide. However, there is no "public beach" there, only the right to access below the high tide line. No one has "beach rights" except the owners of the property along the beach. All of the rest of the area is PRIVATE BEACH. Anthony's palm trees are on HIS PRIVATE BEACH. He does however, allow people to use the beach in front of Anthony Ocean View. How do I know? My family has had a house on this beach, "Crescent Beach", since 1926. We keep it clean, we pay for seawalls, we take care of storm damage, and we pay for the liability insurance. And, Anthony grooms the ENTIRE beachfront , every day with a special machine.
The crap parked on Cove Place, I have no knowledge about obstruction permits given by the City, or the right to have things parked there.
If you want to lay on the sand, go to Lighthouse. If you want to go to a private beach, join a beach club or buy a house on Crescent Beach. Feel free to confirm this with Engineering and the Parks department.
That is why nothing is done about the beach. Because nothing is wrong or illegal on the beach. Don't blame the alderman, or alderwoman before him, the police, the mayor, or the dog warden. Educate yourself.
The public right of way has been blocked off & on for some time now. Free use of the public right of way is the topic of this issue, and the continued, shared concern.
Neighbors should band together and sue the property owner and the City. Call in the DEEP about the pollution of the Cove waters with construction debris. Call in the newspapers. Go to the STate. It's election time... Where's Looney? Where's Megna?
Unfortunately I've also heard people say that they were told to vacate the Morris Cove Community Beach by Anthony's Ocean View employees. Despite misinformation, bullhorn bullying & harassment, most of the neighborhood, not just beachfront properties, have GRANDFATHERED IN DEEDED BEACH RIGHTS so if your property qualifies feel free to enjoy the WHOLE BEACH with your family and friends NOT just the beach/shoreline below the high tide mark (Public Trust Area).
The rest of the public can legally enjoy the approx. 30 foot wide PUBLIC access via Cove Place, traversing the beach down to the water to access the Public Trust Area.
"Connecticut's shore belongs to the people--not just in terms of our environmental and cultural heritage, but in a specific legal sense as well. Under the common law public trust doctrine, a body of law dating back to Roman times, all coastal states as sovereigns hold the submerged lands and waters waterward of the mean high water line in trust for the public. The general public may freely use these lands and waters, whether they are beach, rocky shore, or open water, for traditional public trust uses such as fishing, shellfishing, boating, sunbathing, or simply walking along the beach."
"A littoral landowner may not exclude the public from lawful uses of the public trust area, just as an upland owner cannot exclude the public from driving or walking on the street in front of his or her house."

I have lived in the cove for 45 years . i vive on a side street of of Townsend across from the seawall. The deed to my house states i have access to the beach access but only during low tide. There is a marker part of the sand belongs to property owners directly behind where you would be on the Beach. Yes that access is public access but it is not a public beach :-((
After i left the comment before about living here 45 years i wanted to add I have never had issues using the beach or access to the beach... sorry for type errors had eyes dilated today
As shown on the New Haven Tax Assessor's Map, Anthony's Ocean View Restaurant and beachfront homes do not "own" or have totally exclusive rights to the beach between their property lines and the high tide line because Crescent Beach is a Community Beach so don't let any beachfront homeowners or businesses try to deny Morris Cove neighborhood non-beachfront homeowners out of your Deeded Beach Rights.
