The fronting property owner is responsible for the maintenance and repair of there sidewalk. See Sec 5610 of the Calif State Streets and Highway Code and Sec 12.04 of the Oakland Municipal Code. Oakland PWD our rules do not allow them to use asphalt to repair or patch sidewalks even though they still do out of laziness. They are required to use concrete.

Oak311 - The City of Oakland should investigate the sink hole to determine what is causing it. A blanket assertion that repair is the responsibility of the homeowner is premature w/o investigating the cause of it. The cause will determine how to properly repair it and who is responsible for doing so.

Try contacting the PWD Engineering & Construction, Right of Way Management 510-238-3651. They are the ones that gave us this information when we required to have our neighbor sidewalks repaired and replaced. PWD only picked the cost where there was a official city tree involved and the permit for all the work done.

I've done that before and no one calls me back.
